Abstract
Indigenous people and traditional communities are thus qualified because of the mechanisms of coexistence with their territories and the natural resources available there developed over generations. They are also identified because they have historically faced the threat of large enterprises, the creation of protected areas, farmers who try to encroach on their territories at all costs. In most cases, the deterritorialization of these peoples occurs with the consent and connivance of the state. This paper will demonstrate that these processes of territorial expropriation are provided by indigenous people and traditional communities, implies a patent infringement of rights guaranteed by both the infra-constitutional norms and by the Federal Constitution of 1988.
