Abstract

This paper analyzes the landscape of Standard Essential Patents (SEPs) related to 5G in Brazil between 2015 and 2024 and its relationship with national scientific production. SEPs are strategic instruments for technological dominance worldwide, particularly in the telecommunications sector, where the implementation of technical standards, such as 5G, directly depends on the use of the patented technologies they protect. This research adopts an exploratory and quantitative approach, combining data analysis of SEP filings, extracted from the WIPO Patentscope and ETSI databases, with a bibliometric analysis of Brazilian scientific production from the Web of Science. The results reveal a scenario of deep technological dependence, in which 5G SEPs filed in Brazil are almost entirely owned by foreign companies such as Huawei, Qualcomm, Samsung, and LG, with no significant participation from Brazilian companies or inventors. Meanwhile, there is consistent growth in Brazilian scientific output related to 5G, although this knowledge is scarcely converted into strategic intellectual property assets. The study highlights a structural misalignment between science and technology in Brazil, exacerbated by the country's limited participation in global technological standardization processes.

Marcos Patricio dos Santos Júnior, INPI - Instituto Nacional da Propriedade Industrial

Holds a Bachelor's degree in Electrical Engineering from the University of Brasília (2010) and a second Bachelor's degree in Electrical Engineering from the University of Brasília (2013).
