Jovens infratores no Brasil: Uma análise da governamentalidade dos indesejáveis

Resumo

A problemática do adolescente em conflito com a lei é tema recorrente no Brasil. Este trabalho visa empreender uma analítica da governamentalidade de infratores juvenis durante o século XX no contexto brasileiro. Para sua realização foram analisadas leis e pesquisas que permitem a descrição das práticas discursivas e não discursivas sobre a temática. Percebeu-se, desse modo, a defesa social como justificativa para a internação, marcada pela repressão violenta durante a maior parte do século XX, sendo modificada ao final, depois da instauração de um regime penal previdenciário com ênfase em medidas socioeducativas em meio aberto após o ECA.

 

The issue of lawbreaking teenagers is a recurrent theme in Brazil. The article Young Offenders in Brazil: An Analysis of the Governmentality of the Undesirable aims to develop an analytic investigation of the governmentality of young offenders in 20th century Brazil. Laws and studies were analyzed to enable the description of discursive and non-discursive practices about the subject matter. It was perceived how social defense had been used as a justification for detention, characterized by violent repression for a large part of the 20th century, and was later modified following the establishment of a welfare penal system with emphasis on socio-educational measures in an open environment after the Children's and Young Persons' Act (ECA).
