Verdade real e livre convencimento: O processo decisório judicial brasileiro visto de uma perspectiva empírica

Resumo

Este trabalho, que é parte de pesquisa mais abrangente acerca das garantias processuais no processo judicial do sistema brasileiro, tem o objetivo de discutir e demonstrar, a partir da análise do discurso legal, do discurso doutrinário e do discurso dos atores sociais responsáveis pela construção da verdade jurídica, especificamente os juízes, as representações do princípio do livre convencimentomotivado do juiz e as formas de atualização desse princípio, bem como sua influência na reprodução da distribuição desigual de justiça, tão evidente na realidade jurídica brasileira.

Real Truth and Free Conviction: The Decision-Making Process in Brazilian Courts from an Empirical Perspective, part of broader research into procedural guarantees in the Brazilian judicial system process, analyses legal and doctrinal perspectives and the line of argument of the social actors responsible for constructing legal truth, namely the judges, in order to discuss and demonstrate representations of the principle of free motivated conviction of the judge and forms of updating this principle, as well as its influence on the reproduction of unequal distribution of justice, a stark reality in Brazil.
