Uma Psicologia Social do Direito: Investigações sobre uma magistratura dissidente
Abstract
The article presents the results of a qualitative research that sought to understand how the jurisdiction can be taken as an object of social psychology. The study emphasized the psychosocial conditions of conflicts between hegemonic and dissident practices. Fifteen interviews were carried out with dissident magistrature (those that criticize the Judiciary and the magistrature), through the episodic semi-directed interview. The data was analyzed through an argumentative approach and the interpretation was accomplished based on the referential of depth hermeneutics. The results point to five factors for the psychosocial understanding of jurisdictional production: a) the social origin/class of the magistrature; b) the structure of the judicial organization; c) the psychosocial elements of contemporary society; d) the transformation of the relationship between the Judiciary and the media; e) the magistrature´s self-understanding about the possibilities of its political organization.
