O casamento infantil no Brasil e a proteção da infância: negação de direitos ou ausência de direitos?

Child Marriage in Brazil and Child Protection: Denying Rights or Lacking Rights? Brazil is one of the countries in the world with the highest rate of early marriages, i.e., marriages of children and adolescents. Although it has an advanced child protection legislation, including laws to combat child marriage, some legal frameworks still require better clarification or definition lest children’s rights will be denied. This study aimed to highlight the complexity of the problem of child marriage in Brazil and the need for a multifaceted approach to combat it. Strict legal measures are far from sufficient to address formal marriages, let alone informal ones that take place outside the law. The reasons for child marriage are varied, as we have seen in the case study of families in Campinas supported by Sociedade Educativa de Trabalho e Assistência, and we conclude that achieving comprehensive child protection requires awareness and intervention from all sectors of society. We must continue to promote effective public policies that help set parameters to prevent child marriage.
