O inquérito policial no Brasil: Resultados gerais de uma pesquisa

Abstract

Este texto é fruto de uma pesquisa sobre o inquérito policial no Brasil e traz um pouco de sua história. Buscou-se avaliar como as ambivalências da legislação e da tradição, assim como as mudanças introduzidas nos últimos anos nessa área, encontram solução nas práticas adotadas. Os estudos de fluxo do sistema de justiça criminal têm demonstrado que o principal gargalo está entre a polícia e o Ministério Público e não no Judiciário, que responde pela lentidão. Logo, a efi ciência das “adaptações” ilegalmente admitidas no sistema não tem se revelado verdadeira.

Police enquiries in Brazil: General results of a survey is the product a research study into police enquiries in Brazil and presents a little about the history of such enquiries. The study aimed to assess how the ambivalent aspects of legislation and tradition, as well as the changes introduced to this area in recent years, have produced solutions in the practices adopted. Studies into the process fl ow of the Criminal Justice System have shown that the main bottleneck lies between the police and the Federal Prosecution Service, and not in the Judiciary, which is held accountable for the delays. Therefore, the effi ciency of the illegally fostered “adaptations” to the system is not shown to be true.
