Permanências e resistências: Legislação, gestão e tratamento da delinquência juvenil no Brasil e na França

Abstract

O artigo compara e contrasta respostas ins­titucionais dadas aos adolescentes acusados de atos infracionais no Brasil e na França. Utilizam-se dados da contabilidade oficial dos dois países e de trabalho de campo nas cidades de Lille, na França, e de Belo Hori­zonte, no Brasil. Na França, vemos resistên­cias às mudanças legislativas e à política de natureza securitária voltada para jovens infratores, liderada pelo Parquet. No Brasil, mantém-se um tratamento punitivo herdado dos períodos anteriores e à adoção incom­pleta e insuficiente da doutrina da proteção integral proposta pelo Estatuto da Criança e do Adolescente (ECA).

The article Permanence and resistance: legislation, management and treatment of juvenile delinquen­cy in Brazil and in France compares and contrast, against the backdrop of legislative changes, the state responses to youth who commit an offense in Brazil and in France. We use official data relating to young offenders in France and Brazil and we conduct field work in the cities of Lille, France, and Belo Horizonte, Brazil. In France, there is resistance to major legislative changes and also to security-related policy focused on young offenders, led by the Parquet. In Brazil, the deep history of violence and human rights violations, especially violence against children and adolescents, has led to the maintenance and updating, through new devic­es, of a punitive treatment inherited from previous periods, without regard to the rights of these populations.
