Ten years of jurisprudence of the Committee on the Rights of the Child on Individual Communications
Impact on the adaptation of Justice to childhood
Abstract
The article analyzes the jurisprudence of the Committee on the Rights of the Child regarding Individual Communications in the celebration of the 10th anniversary of the approval of the respective Optional Protocol to the Convention on the Rights of the Child and which, in Brazil, was ratified by Decree No. 12.313, of 2024. As the communications take place when the interested parties understand that their rights have been violated and not adequately guaranteed in the domestic sphere, the jurisprudence of the Committee problematizes ways in which the rights are enforced by the States, as well as guidelines for improvement by the Justice for a broader guarantee of children's rights
