THE INTERNATIONAL LABOR ORGANIZATION ROLE ON THE PROTECTION OF THE RIGHTS OF IRREGULAR MIGRANT WORKERS
Resumen
This article talks about the role of the International Labor Organization (ILO) in protecting the rights of irregular migrant workers towards the ongoing human mobility crises in international society. To this end, we seek to briefly contextualize the world migratory situation numbers and discuss, also briefly, international legal instruments on the protection of migrant workers to then address the importance and role of the ILO, as the main international actor in protection of the rights of migrant workers, also mentioning some theoretical waves that contribute to unraveling the problem. The ILO has great relevance in developing policies to promote the development, including personal and human, of migrant workers in irregular situations, but this action needs to be complemented by other mechanisms. To this end, the theories developed by Cortina, Ferrajoli and Galtung are of relevance, representing new turns, which go beyond the purely legal meaning of a legal norm and its rigidity, to contemplate other facets beyond the legal, based on solidarity and premises centered on in the human being, in which the right to develop decent work without territorial restrictions is embedded. The methodology applied was qualitative, based on bibliographical review and analysis of related international texts and documents.
