Adoption of Conciliation and Mediation Mechanisms in Brazilian Courts

The adoption of alternative mechanisms of conflict resolution has been one of the main strategies of the Brazilian Judiciary to face the high demand for justice services in the country. The article seeks to identify variables related to the courts that influence the adoption of conciliation and mediation mechanisms. Through statistical analysis of official data from the Judiciary, the study shows that the reconciliation index depends directly on the size, available workforce, caseload and productivity of the courts. The influence of these variables occurs differently in each of the justices investigated.Downloads
