The Universal Legal Tools of Private Security: A Study on the Right to Question, Use Physical Strength and Arrest of Private Securities in Brazil

Abstract

Little is known about the legal tools of private security guards to perform their work. This article aims to contribute to filling this gap. What are the grounds and limits given by the Judiciary to private Brazilian security guards for the exercise of the rights to question, use physical force and arrest? A qualitative and quantitative analysis of a random sample of prosecutions judged between 2010 and 2012 in the Courts of the states of São Paulo e Paraná shows that, although the Criminal Code, Civil Code and jurisprudence confer these rights in certain circumstances, they are limited by the courts.
