Transvestite Has No Forgiveness: The Function of Punishment as Justice and Revenge

The article examines the perspective of society regarding the function of punishment, based on analysis of the influence that the media exerts to consecrate ideas of violence and punishment, and the influence of characteristics of the accused and the victims. To do so, it presents a literature review of the sentence theory and a comparative analysis of two cases that had different treatments in the media. As a conclusion, it is observed that the sentence theory that comes closest to the social option is retributive theory, confusing justice with revenge, in order to give symbolic support to eliminate the objectified fear that some people carry.Additional Files
