The Role of the Prisoner in Custody Hearings: Protagonist or Marginal?

This article aims to discuss the participation of prisoners during custody hearings. Is the relevance in thesis conferred by custody hearings to the presence of this figure, the prisoner, really observed? Or are values, stigmas and representations contributing to invisibilize these individuals? Finally, what is the position of the prisoner in relation to the other actors present in the scene? The research, based on direct observation of 210 custody hearings held at the Barra Funda Criminal Forum, points out that despite procedural changes, the discredit attributed to the narratives of the imprisoned individuals remains, and even reports of institutional violence are disregarded.Published
