Detention Hearings: An Analysis of the Displacement Policy of Pretrial Detention Hearings to the Public Jail in the City of Rio de Janeiro

The paper discusses the transfer of the Central de Audiência de Custódia from the Rio de Janeiro’s Court of Justice to the José Frederico Marques Jail, in Benfica, in light of three aspects: a) the displacement of the justice service; b) the public dimension of justice; and (c) the understanding about incarceration device enhancement. The data was collected during fieldwork carried out between June 2017 and May 2018. Conducting the hearings in the public jail restricts public access to the hearing. The change has also favored the decision to keep prisoners in custody, producing an enhancement of the incarceration device.Published
