Resumo

This study seeks to study the margin of appreciation doctrine and its implementation by the European System of Human Rights and Inter-American System of Human Rights. This doctrine originated in the European System and was developed by the European Court jurisprudence. The Inter-American System (such as Inter-American Commission and State Party) used the doctrine based on the European Court of Human Rights jurisprudence. Despite being mentioned by Inter-American Court, the margin of appreciation has not been accepted by it.

É doutoranda em Direito Internacional pela Universidade do Estado do Rio de Janeiro (UERJ). Bolsista CAPES. Mestre em Relações Internacionais pela Universidad Torcuato di Tella (Buenos Aires, 2018), pós-graduada em Ajuda Humanitária e ao Desenvolvimento pela PUC-Rio (2013), Advogada, com formação jurídica pela Universidade Candido Mendes (graduação, 2011). É especialista em Direitos Humanos, com experiência profissional na Comissão Interamericana de Direitos Humanos. Pesquisadora do LEPADIA/UFRJ. Pesquisadora do NEPEDI/UERJ. Estudou Direito Internacional Público na Academia de Haia na Holanda e Direitos Sociais na Universidade de Lisboa. Experiência de advocacia na área de Direito Internacional e Direitos Humanos em escritórios jurídicos e ONGs. Professora licenciada da Candido Mendes, Advogada colaboradora na área de direitos humanos na Universidade Federal do Estado do Rio de Janeiro (UNIRIO). Juíza em Competições Internacionais de simulação da Corte Interamericana desde 2017 (Moot Court American University -USA e Intituto Colombiano de Derechos Humanos)
