Abstract

This article aims to analyze the historical and cultural construction of social understanding about disability, as well as studying important decisions handed down by the Inter-American Court of Human Rights regarding the rights of people with disabilities that have been violated. Through this research, we intend to analyze the issue of human rights from the perspective of international justice, carrying out a study on the judicialization of the rights of people with disabilities at the international level, with an emphasis on the Inter-American Human Rights System. Furthermore, a study will be carried out on the challenges and advances perceived in the application of the provisions of the Inter-American Convention on the Elimination of all Forms of Discrimination against Persons with Disabilities. The methodology used in this work consists of developing an exploratory theoretical research on the themes considered important for the construction of the study. To this end, the hypothetical-deductive approach method was adopted with the aim of understanding the great relevance that international law plays in the issue of protecting the rights of people with disabilities.
