Abstract

The paper aims to suggest an approximation between two theoretical approaches, the sociology of punishment developed by Loïc Wacquant and the institutional approach of John Sutton, as an analysis proposal for the hyper-incarceration phenomenon in Brazil. Therefore, we will introduce the concepts of Wacquant’s theory, followed by an analysis of the institutional criticism of his approach. Finally, we propose an essay on the possibility of adapting both approaches into a critical analysis of the Brazilian penal regime, which takes into account its local particularities, in order to contribute to the law and development debate.
